Use of the BrochureBox System is ANONYMOUS by default. So feel free to browse our pages with no concern of being personally identified. Only when you share personal information or place a phone call via a hyperlink on one of our web pages will you and your browsing history be individually identified by the BrochureBox System and made available to an account holder (ie: real estate agent). For security and reporting purposes, we collect information on every interaction with our systems. We do NOT re-sell the information we collect to third parties. -TERMS OF SERVICE-
Definitions:
System = The BrochureBox Listing System.
Customer = An individual natural person, or representative of a legal entity, having an account with BrochureBox LLC. Also known as an account holder or subscriber.
User = Anyone who interacts with the BrochureBox System and views the BrochureBox™ listings under normal circumstances.
You/Your = Can refer to either a Customer, a User, or both.
We or Us = BrochureBox LLC

A BrochureBox system account is intended for use on a per person basis. You agree that only one Customer will own and use each account you establish with BrochureBox LLC. Brokers or real estate offices wishing to enjoy the benefits of the BrochureBox system are required to purchase the BrochureBox system on an individual basis for their agents rather than purchase one subscription for all their agents or for their whole office to use. Sharing of an account amongst multiple individuals, agents or legal entities is strictly prohibited. You agree to abide by both the letter and the spirit of this restriction. BrochureBox LLC reserves the right to audit accounts to determine if you are abiding by the terms of this agreement. You agree to cooperate with such audits when requested to. Multiple people or agents on a single account is grounds for termination without refund. Each account subscription is limited to a maximum of 50 property listings. Legal entities who wish to have an account must appoint an individual person to act as the account holder. It is permitted for multiple accounts to link to (a) common phone number(s) for purposes of scheduling showings. Account holders may appoint persons to act on their behalf to update listings and run reports. It is up to BrochureBox LLC, in it's sole discretion, to decide whether or not an account is in violation of this restriction.

To ensure the highest levels of security, WE DO NOT STORE YOUR CREDIT CARD INFORMATION IN OUR DATABASES. Credit card information for recurring annual payments is kept by the credit card company. We will ask you for your credit card information with each new purchase you make.

The BrochureBox rider signs, with their rounded corners, were designed specifically with safety in mind. Customer will take all necessary measures and responsibility to ensure all signs used in conjunction with the BrochureBox listing service are used safely and securely at all times. The Customer shall indemnify and hold harmless BrochureBox LLC, and defend in court if someone gets injured, or if any property damage occurs, from any contact with one of the Customer's signs used in conjunction with the BrochureBox listing service. You agree to use only the sings provided by or purchased via BrochureBox LLC in conjunction with the BrochureBox services. You may not manufacture or have manufactured for you, your own signs for use with the BrochureBox system. In order to keep a consistant professional image across the BrochureBox system, customers are required to put their Property ID's on their signs in a clean, neat and orderly fashion. To facilitate this need, customers are required to use either pre-printed numbers or a stencil template when putting thier Property ID's on their signs.

You recognize that the BrochureBox service is an annual subscription with an automatically recurring payment. You authorize BrochureBox LLC to charge your credit card for this annual payment and any products (ie: signs) you may include with your annual subscription renewal. When you initially sign up for or renew the BrochureBox services, your payment may be processed as two separate transactions; one for the annual subscription and one for any additional products you order. Your credit card will be automatically charged each year for a new annual subscription on or after your annual renewal date. Recurring payments shall continue for 5 years or until you cancel them via the BrochureBox website. You may cancel your subscription at any time via the BrochureBox website at http://www.BrochureBox.biz/. It is your responsibilty to cancel your subscription at least 24 hours before the renewal date if you do not wish to continue your subscription. THERE ARE NO REFUNDS FOR ANNUAL SUBSCRIPTIONS. Prices are subject to change and you are responsible for staying aware of current prices before renewing your subscription.

You agree that partial refunds may be processed as two transactions: First, a full refund for the original charge will be given and secondly, a new charge will be applied for the products you are purchasing.

ALL SALES ARE FINAL. NO EXCHANGES. NO REFUNDS. No refunds will be given for early cancellation of services. No refunds will be given for non-acceptance of new or updated Terms of Service.

BrochureBox LLC will do it's best to make sure your listings are available as often as possible, but some interruptions in service are inevitable and are to be expected. Additionally, from time to time, the BrochureBox system may be taken offline for repair, upgrades or scheduled service. The BrochureBox websites may or may not be available during these times, depending on service & maintenance needs. BrochureBox LLC makes no service guarantees and does not offer refunds or any type or compensation for interruptions of service.

BrochureBox LLC reserves the right to terminate this agreement and/or any account, at any time, for any reason whatsoever. No refunds will be given for early termination of an account. BrochureBox LLC is under no obligation to refund any account holder for early termination of an account. BrochureBox LLC is under no obligation to give specific cause nor explain why an account is cancelled. BrochureBox LLC is under no obligation to refund any account holder for their investment in BrochureBox signs that would be rendered unusable due to termination of an account.

This written agreement constitutes the only and entire agreement you have with BrochureBox LLC regardless of any promises made by any employee or representative of BrochureBox LLC.

You agree to comply with any requests to replace your signs with updated signs; signs which would be paid for by BrochureBox LLC. This would need to be done in order to be in compliance with trademark rules, regulations and laws. You agree to replace said signs and cover any costs you may incur for doing so. Failure to replace said signs would subject you to liability for any possible trademark damages caused by your failure to timely replace your signs with new signs provided by BrochureBox LLC.

You recognize that you may incur text messaging fees from your carrier if you choose to have a text message (SMS) sent to your phone as notification of a visit to one of your listings. You may be charged by your phone company for messages coming into your phone. BrochureBox LLC does not charge you for any text messaging services.

You recognize that the signs sold by BrochureBox LLC are "rider" signs as commonly referred to in the real estate industry. These are not stand-alone signs and will need to be attached to another sign or structure.

Data security is extremely important to BrochureBox LLC. We have incorporated many layers of security measures to help ensure the safety & security of our data. You recognize that for security purposes, we may store credit card numbers and other sensitive data in an encrypted format on our servers and/or in our databases and we transmit sensitive data securely via standard industry security practices like SSL (Secure Socket Layer). You agree to not interfere with, inhibit, thwart or avoid the secure transmission of sensitive data or any of BrochureBox LLC's security measures. Doing so may cause automatic suspension and/or possible termination of your account. Before being allowed access to your BrochureBox Account, you may be required to confirm that your email address is truely connected to an active email account in that we will send you, via email, a validation code in a hyperlink which you will have to click on and follow within a limited period of time (ie; 48 hours) in order to validate and activate your account. Once your account is validated, you will be able to login at your convenience.

You agree to allow BrochureBox LLC to contact you from time to time via email to make you aware of sales events and /or to tell you about other information about the BrochureBox services. You recognize that there is no email opt out provision for our customers. You agree to not report or blacklist our email address(es) to any ISP. You agree, as long as you are our customer, not to report us to any authorities as a spammer. If you do so, you will defend and hold harmless BrochureBox LLC in any court of law.

The legal jurisdiction where any legal actions may take place against BrochureBox LLC is in Illinois where BrochureBox LLC is incorporated.

You agree to engage in arbitration instead of taking legal action, in a court of law, against BrochureBox LLC. You agree to be bound by the determinations of the arbitrage officials.

You recognize that there are inherant security risks in using any website and will take all necessary security precautions to ensure that your username and password are not compromised. This includes but is not limited to taking special care when using both public and private wireless networks. You will take full responsibility for any damages caused by your lack of taking such precautionary measures. Additionally, you agree to indemnify and hold BrochureBox LLC harmless in the event that that your data is ever compromised.

You agree to keep your property listing data up to date at all times. Failure to to so is grounds for termination of your account.

If BrochureBox LLC is ever sold, you agree to work cooperatively with the new owner(s).

You must explicitly cancel your subscription at least 24 hours before your account's anniversary date in order to avoid automatic renewal of your subscription.

Your use of the BrochureBox services indicates your acceptance of the current Terms of Service. It is your responsibility to keep aware of any changes to the BrochureBox LLC Terms of Service.
